Black Jury Law Clinix (Proprietary) Limited (BJL) is a family-owned business, which offers private law related legal services in general with emphasis and focus on the Law of patrimony. The Law of Patrimony is that part of the private law which regulates the relationships between persons with respect to their means. In this context, “Means” refers to the sum total of a person’s assets and liabilities, in other words; their entire estate.
Thus, our specialisation lies in the Law of Succession. Enabling us to assist clients to plan the dissolution of their deceased estates better, in the event of death. The administration of such deceased estates is usually attended to quickly and seamlessly where someone had planned timeously and attended to the drawing of a will and last testament. The winding up of deceased estates takes much longer where someone dies without a will (intestate). In such cases, the law of intestate succession will determine who the heirs of the deceased are going to be.
Administration of Deceased Estates
The administration of deceased estates is the process of winding up the affairs of the deceased person whether dying with or without a will. In the event of death, certain legal procedures need to be followed in order to have the process of estate administration done swiftly and meticulously.
Assets in a deceased estate, both movable and immovable, need to be valued at the current market value of the asset as at the deceased date of death. Regardless, whether a person dies testate or intestate, it is a prerequisite to complete the inventory form when reporting the estate to the Master.
Last Will and Testament
Our professional consultants’ welcome clients coming for advice or those wishing to execute the last will and testament. We listen carefully and take detailed instructions from clients and keep proper record of the meeting. Where possible, we advise clients on what can and cannot be done in the process of drafting a will.
When making planning decisions on asset distribution, either before or after death, consideration needs to be given to the correct and most tax-effective financial structures and arrangements to protect a family’s interests, now and in the future.
Undoubtedly, trusts are useful and holistic estate planning and succession plan tools. They provide a number of benefits e.g. fiscal, asset protection and people protection (sometime against themselves).
